Article 1 – Definitions

Cooling-off period: the period within which the consumer can exercise the right of withdrawal.

Consumer: the natural person not acting in the course of a profession or business who enters into a distance agreement with the seller.

Day: calendar day.

Long-term transaction: a distance agreement related to a series of products/services spread over time.

Durable medium: any tool that enables the consumer or seller to store information in a way that allows future reference and unchanged reproduction.

Right of withdrawal: the option for the consumer to cancel the distance agreement within the cooling-off period.

Model withdrawal form: a form provided by the seller that the consumer can fill in to use the right of withdrawal.

Seller: the natural or legal person offering products/services remotely to consumers.

Distance agreement: an agreement made exclusively using remote communication techniques.

Remote communication technique: tools used to conclude agreements without simultaneous presence.

Article 3 – Applicability
These terms apply to every offer made by the seller and all distance agreements between seller and consumer. The terms will be made available before concluding the agreement. If not feasible, consumers will be informed where they can access the terms.
Article 4 – The Offer
Offers are clearly described and include essential information like total price (including taxes), delivery costs, payment methods, and applicable withdrawal rights. Obvious mistakes do not bind the seller.
Article 5 – The Agreement
An agreement is concluded when the consumer accepts the offer and meets the conditions. For online purchases, confirmation will be sent electronically. The seller ensures secure transactions and may assess the consumer’s creditworthiness before finalizing the agreement.
Article 6 – Right of Withdrawal
Consumers can return products within 14 days without providing a reason. They must handle the product with care and return it in original condition if they wish to withdraw. Notification of withdrawal must be given via email or the model form.
Article 7 – Costs in Case of Withdrawal
Return costs are paid by the consumer. Refunds are made within 14 days using the original payment method, provided the return is received or proven. If the product is damaged due to mishandling, a depreciation may apply.
Article 8 – Exclusion of Withdrawal
The right of withdrawal may not apply to:

Customized or perishable goods

Sealed hygiene products once unsealed

Services already performed with consumer consent

Newspapers/magazines or software with broken seals
This must be clearly stated in the offer.
Article 9 – Price
Prices remain fixed during the offer period unless influenced by VAT changes or market fluctuations. All prices include VAT. In case of pricing errors, the seller is not obligated to honor them.
Article 10 – Conformity and Warranty
Products must meet legal requirements and those described in the offer. Any defect must be reported within two months. Warranty aligns with the manufacturer’s policy.
Article 11 – Delivery and Execution
The seller ensures careful handling and dispatch. Orders are delivered within 30 days unless agreed otherwise. If delayed, consumers may cancel and get a full refund within 14 days. Risk transfers upon delivery.
Article 12 – Long-Term Contracts
Consumers can cancel long-term or auto-renewing agreements with a maximum one-month notice. Auto-renewals are restricted and must be clearly disclosed.
Article 13 – Payment
Unless otherwise agreed, payments must be made within 7 working days from the end of the withdrawal period. Consumers must report incorrect payment information immediately.
Article 14 – Complaints Procedure
Complaints must be submitted within 2 months. They will be handled within 14 days. If unresolved, the dispute may be submitted via the EU ODR platform: http://ec.europa.eu/odr.
Article 15 – Disputes
Only Dutch law applies, even if the consumer lives abroad. The Vienna Convention does not apply.
Article 16 – Additional Provisions
Any additional or deviating clauses must not disadvantage the consumer and must be provided in writing or via a durable medium.
